¡ABSOLUTAMENTE NO!.

No quiero aplausos, quiero respuestas.

"NOT AGAIN...! Can South America Boxing survive these constant deliberate injustices? Will the WBO Grant an Investigation and Review?"

By Eddie Montalvo

In the wake of what was an embarrasment and an injustice in the sport of women's boxing, I am compelled by integrity and my responsibility to Ms. Duda Yankovich and, every boxer out there whether or not I represent them, to write the following and publicly petition the International Arbitrator's Commission to intervene and conduct an investigation as to this past weekend's result on the Duda Yankovich vs Enis Pacheco bout for the vacant WBO lightweight title; petition the WBO to assign an impartial independent panel of International Arbitrators to review fight video in hopes that upon its finding they would rule the Yankovich-Pacheco bout a NO CONTEST and mandate a rematch and, petition for Mr. Julio Torres, President of the Columbian Boxing Federation (FCB) to BAN Mr. Juan Carlos Devia from promoting the rematch between Yankovich vs Pacheco should it be granted due to his dishonesty and attempt at extortion.

I'm told some say that I should keep from stirring the water. ABSOLUTELY NOT!!! My intent isn't to cause controversy, Mr. Devia did that already as he was the author who caused these controversies, in part, with his actions and, the WBO officials, in part, by their erroneous decision. We cannot be blamed nor ridiculed for exercising our rights!

I have a responsibility and my ethics, my integrity and my profession demand I speak out and defend not only the rights of Duda Yankovich but the RIGHTS of every boxer that has been hurt by people like Mr. Devia. I cannot be afraid to jump into the water with the 'Sharks' of our industry specifically when I have every right to do so and the evidence to support our claim. I do not care to be applauded, We want answers! Our sport has suffered enough!

If there is TRUE impartiality within the FCB and the WBO then both the WBO and Mr. Torres will grant this petition and allow the FULL FIGHT video to be reviewed as the sport of boxing in South America has once again received a bad rap because of a bad decision. I know first hand that there are few HONEST and TRANSPARENT promoters in Latin and South America and to these gentlemen, I apologize that the sport in your region suffers these kinds of controversies, once again.

In a year (2012) that women boxing has the opportunity to shine and to really solidify itself in a male dominated sport, once again it is tainted by unjust decisions such as was done by the WBO officials officiating the WBO title bout between Duda Yankovich vs Enis Pacheco this past weekend in Barranquilla, Colombia, by crowning Ms. Enis Pacheco the New WBO Lightweight Champion of the World. This decision can hurt Ms. Pacheco along the way. With all due respect to Ms. Pacheco, although she fought a valient fight in everyone's, including my own, opinion, she loss the bout.

The week began with an unforeseen curve ball by promotor Juan Carlos Devia of Probox Del Caribe promotions. The initial Contract signed on January 20, 2012 by all parties was modified after the fact by the promotor. The Yankovich camp was unaware of the promoter's modifications until we arrived in Barranquilla. On Monday March 12, 2012, during a meeting at the Hotel Barranquilla Plaza, Juan Carlos Devia presented me with a modified contract in which he was to be Ms. Yankovich's promoter for 4 fights with a guaranteed purse (Confidential) and percentages for TV broadcasting and/or that he would receive 30% of her purse if I obtained any bouts outside of his promotion. I told him that he was insane if he thought we can be extorted and insisted he either honor initial contract or compensate Ms. Yankovich 25% of the purse as agreed upon as per contract should bout not take place while we are in Columbia. Ms. Yankovich was present.

Mr. Devia became irrate and slammed his fist on the table and threatened we would be detained from leaving the Country if he suffered a loss and that we would have to pay his losses. I said to Mr. Devia (with a Big Smile on my Face) that he had "no power nor legal grounds" to detain anyone as the contract doesn't specify we pay for his losses. I went further saying that should he insist on attempting to extort us that I would personally call the local authorities and insist he honor contract and I would notify the FCB of his dishonesty. And that I am licensed and known in Columbia for my work with my Columbian fighters, for my integrity and for my transparency. He asked for a day or so to come back with a better offer.

Ms. Yankovich and I discussed the options and decided on allowing the promoter to either come back with a better offer or honor intial contract. Two days later Mr. Devia presented us with an agreement satisfactory under the circumstances and a deal was struck. However, his unprofessionalism was unprecedented. In this meeting sat Mr. Julio Torres, President of FCB. Mr. Torres made it clear that parties needed to come to an agreement in order for the bout to be sanctioned.

Let's just say that Mr. Devia did not like the fact that I stood my ground on Ms. Yankovich's behalf. We (Team Yankovch) believed Duda could defeat Pacheco...

I was hoping to have in my posssesion the full fight video to accompany this writing. Ms. Yankovich has given a statement in Brazil via Mr. Gabriel Leao's Blog and others in which she accuses Mr. Devia of impropreities; among other statements, with merit mind you. However, there are several main factors in play here that support our petition; First, it is very important for the International Boxing Community to be informed of what occured in Barranquilla the week leading up to the bout and the manner in which the promoter conducted himself; to petition the WBO and FCB to sumbit to an independent panel's investigation and review of full fight video and, for the FCB to suspend Mr. Carlos Devia's promoter's License pursuant to the FCB's regulations for dishonesty.

FIGHT NIGHT: We knew going in that we may have some odds against us but it was evident by the fifth round that Duda had ALL ODDS against her when the referee failed to admonish and penalize Pacheco for her continuos grabbing (see this vid which is a Pacheco fan created one by the way and focus on Duda's right foot as it slips from under her and she bounces right up off her knee on the attack and both boxers exchanged blows before referee Hiram Rivera stepped in to give Duda an 8 count -

http://www.youtube.com/watch?v=y91nIYUQBAo).

Although it may have appeared Yankovich went down in the initial round by a left hook thrown by Pacheco, the blow wasn't effective as it went off Yankovich's right glove as Yankovich's right leg slipped from under her causing her to hit one knee and glove and bounce right back up for the attack. From that moment on Yankovich went on the attack with the better shots of the two all the while Pacheco grab at every opportunity sneaking in a punch here and there during clutches she initiated. The referee failed to observe that but the video will not lie. He also failed to admonish and/or penalize Pacheco for her continuous holding and grabbing.

By the fifth round this writer (Eddie Montalvo, also Yankovich's manager) calls referee Jose Hiram Rivera over to him between rounds and asks him to admonish Pacheco for all the holding she was doing throughout rounds 1 and 5. He ignored my request and allowed Pacheco to continue to grab and hold the entire bout. In any other international bout be it a world title or not, any referee would have not only admonished Pacheco they would have deducted a couple of points for the consecutive grabbing and hitting throughout 9 consecutive rounds. The fight video will demonstrate the negligence on Mr. Rivera's part in failing to admonish and penalized Pacheco.

Yankovich fought an intelligent aggresive fight demonstrating her experience but Pacheco's grabbing and holding complicated Yankovich's full attack. Clearly Yankovich was the dominant of the two delivering effective blows and the more solid punches. A dedicated veteran fighter such as Ms. Duda Yankovich DID NOT deserve to be ridiculed...

The Yankovich Camp publicly submits this Petition as we are confident it will be ruled a NO CONTEST upon review.

"We deserve and want answers, the International Boxing Community wants and deserves answers..."
